A combination of widespread internet availability and increasingly onerous legislation has transformed data protection and privacy in the workplace in recent years. Little more than a decade ago, most organisations ran their HR records on IT systems but were severely restricted by storage limits, access speeds and in most cases, limited internet use. The amount of personal data a company can hold on an employee is almost limitless, and in today's virtual world of online recruitment and social networking there is more information available through the internet than ever before.

Several high profile government organisations, including the Home Office and the Department of Health, have hit the headlines for breaching data protection regulations – ultimately damaging the employer brand. These data losses have not only put legislation to the test but have put all data holders in the spotlight. Activities of employees outside the workplace have also raised further concerns.

Charissa Gooch

Michael Bradshaw is a partner in the Employment and Pensions Service Group of City firm, Charles Russell LLP. Michael specialises in all aspects of employment law and has built up particular expertise in the area of atypical workers and the employment rights of agency staff. Michael acted for Cable & Wireless in the widely reported Muscat –v- Cable & Wireless case and has experienced the treatment of this issue by the Tribunals and Courts, all the way up to the Court of Appeal. Muscat remains a key decision in understanding when employment rights may arise, as identified in James –v- Greenwich Council. He advises a range of clients on these issues and his clients in this area include national and international employment agencies. He regularly provides client training on the matter and speaks on the subject. Michael otherwise provides advice to businesses on the full range of employment matters, including managing dismissals, Employment Tribunal claims, reorganisations and redundancies and TUPE transfers. His expertise in this area was also recognised by the Legal 500 (2006 Edition) and he is a regular contributor to the HR and personnel press. Charissa Gooch qualified into the Employment & Pensions Service Group in 2004 after completing her training contract at Charles Russell.  Charissa advises both companies and individuals on all aspects of employment law, both contentious and non-contentious, for a wide range of clients, including those in the utilities, finance, telecoms, leisure, retail and transport sectors.  Charissa is also a member of Charles Russell`s Data Protection team and has been involved in a number of large-scale Data Protection Audits, as well as providing day-to-day advice on Data Protection issues.  Charissa regularly carries out client training and speaks at internal and external seminars.
