In brief:
The Equality Act received Royal Assent on 8 April, and the bulk of the legislation is due to be implemented in October.
The Equality Act introduces new laws to help narrow the gender pay gap and strengthens anti-discrimination legislation. It also consolidates the numerous pieces of existing discrimination legislation into one Act. It has provoked a great deal of controversy since it was first unveiled and the Equality Act 2010 will have significant impact on both public and private sector organisations.
The Equality Act is the most far-reaching discrimination legislation for years: it allows employers to take further positive action in favour of women and minorities at the recruitment and promotion stage, gives wider powers to employment tribunals, bans 'gagging clauses' on pay, and requires some organisations to publish diversity and gender pay statistics. All employers need to review their personnel policies in light of this new equality legislation. Ending discrimination in terms of race, gender, disability, religion and belief, age and sexual orientation and embedding equality in their organisations will help employers recruit and retain the best employees.

Penny Macmillan
Penny Macmillan MA Chartered FCIPD is a Solicitor and has for many years specialised in employment law, with particular experience of: TUPE, unfair dismissal, discrimination, whistleblowing and drafting employment contracts, policies, procedures and handbooks. She is former Head of the Legal Department at The Race Equality Centre and now practises in her own firm.
Before qualifying as a lawyer, Penny held positions as a Group Personnel Manager for a health authority; Employee Relations Manager for a major retailer; and Personnel and Training Manager for a large catering services company. Penny is equally well qualified and experienced as a management trainer, HR specialist and lawyer. She delivers workshops and seminars on a wide range of employment law and best practice subjects and is a personal tutor on JSB’s Advanced Certificate in Employment Law (ACEL).
